Teen Safe Driving Awareness Contest


Official Rules (“Rules”)


THE CONTEST
D3NJ Teen Safe Driving Awareness Contest invites eligible participants to design and develop a production ready multi-media teen safe driving campaign. An explanation of the Contest theme can be found online at: http://d3nj.org.

SPONSORS
The Sponsor of this Contest is the DCH Teen Safe Driving Foundation located at 955 US Hwy 9, South Amboy, NJ 08857 (“Sponsor”). Contest prizes are provided by the Sponsor.

ELIGIBILITY
The DCH Teen Safe Driving Awareness Contest (“Contest”) is open to: (a) United States citizens and legal residents of New Jersey who are full- time high school students attending a public or private high school, or are being home schooled, in the State of New Jersey on and through May 5, 2012, and (b) who have internet access. Entrants who meet the foregoing requirements are referred to as “Qualified Participants.”

By entering this Contest, all entrants accept and agree to be bound by these Rules. Any violation of the Rules may result in disqualification. All decisions of the Judges regarding this Contest are final and binding in all respects.

Any entrant and/or Qualified Participant who on or before January 19, 2012 is an immediate family member (defined as parents, children, siblings, and spouses) of and/or is domiciled (whether related or not) with any of the employees, officers, directors, agents, representatives, attorneys, advisors and/or the like of any of the following and/or their respective affiliates is not eligible to participate in this Contest:

a) DCH Auto Group and/or any dealership or other entity affiliated with the DCH Auto Group;
b) The DCH Teen Safe Driving Foundation;
c) Any Judge for this Contest

No purchase or payment of any kind is necessary to enter or win this Contest.


HOW TO ENTER.
All entrants must comply with these Rules. To participate in the Contest, Qualified Participants must also submit a signed and completed Registration Form, Release Form and Parental Permission Form, if and as applicable. All Qualified Participants under the age of 18 must have their parent or guardian sign the Parental Permission Form and Release, and each Registration Form must be signed by an adult.

STAGE I: REGISTRATION
Qualified Participants must also register to participate in the Contest. Online registration at http://www.d3nj.org/enter_the_contest.aspx must occur during the Registration Period which will open at 12:01am (EST) on January 19, 2012 and close at 5pm (EST) on February 15, 2012. Any online or other registrations submitted and/or received after 5pm (EST) on February 15, 2012 will not be considered.


STAGE II: SUBMISSION OF CAMPAIGN IDEA
Registered Qualified Participants will have until 5pm (EST) on March 7, 2012 to submit their Campaign Idea using the form online at http://www.d3nj.org/enter_the_contest.aspx. The Campaign Idea must contain the campaign name, a tag line or concept line (not to exceed 150 characters), a short synopsis describing the Qualified Participant’s proposed teen safe driving awareness campaign (not to exceed 300 words), and the selected media or element(s) that will be used in the campaign.

At least one of the following media/elements must be utilized in the campaign. You are not limited to the number of media/elements that you use:
  • A website
  • Video PSA (Public Service Announcement)
  • 30 or 60 second cable spot
  • 30 second radio spot
  • Social media page/site
  • Classroom curriculum
  • Local community or school event
  • Billboard or outdoor campaign.

Any online or other Campaign Idea submissions submitted and/or received after 5pm (EST) on March 7, 2012 will not be considered.

Submit your Campaign Idea by uploading it according to the instructions listed on the website at: www.D3NJ.org.

All entries will become the property of the Sponsor and will not be acknowledged or returned.

PUBLIC VOTING
All Campaign Ideas received in compliance with these Rules will be posted online at www.D3NJ.org, where they will be voted on by the general public generally on the basis of originality, creativity, adherence to the theme, and overall quality.

Public voting can only occur online at www.D3NJ.org and will be open from 8am (EST) on March 12, 2012 until 5pm (EST) on March 23, 2012. No votes will be counted after 5pm (EST) on March 23, 2012. The Qualified Participants receiving the highest number of votes will be determined to be Finalists and will move on to compete for the Grand Prize. Finalists will be notified via phone or the email provided on the Registration Form. Finalists who are minors will be notified via their parent or guardian identified on the Parent Permission Form. The Finalists may be required to prove eligibility requirements and compliance with the Rules.

If a Finalist cannot be contacted and/or does not respond within three (3) days from the date the Sponsor first tries to notify him/her, such Finalist forfeits all rights to win the Contest or receive the Prize(s). It is expected that there will be 10 Finalists; however, in the event of any ties in the public voting there may be more than 10 Finalists (hereinafter, “10 Finalists” will mean the 10 or more (in the event of voting ties) Finalists selected by the public.

STAGE III: FULL PROJECT OUTLINES
The 10 Finalists will have until 5pm (EST) on April 20, 2012 to submit their Full Project Outlines for their teen safe driving campaign proposal. The Full Project Outline is expected to generally adhere to the Finalist’s Campaign Idea and include at a minimum:
  • a detailed description of the campaign;
  • videos, scripts, storyboards, mock-ups, plans and/or conceptual ideas ready for production/implementation;
  • estimated production budget (not to exceed $10,000);
  • and estimated timeline for production.
Any Full Project Outline submitted and/or received after 5pm (EST) on April 20, 2012 will not be considered.

The 10 Finalists (and a parent/guardian if Finalist is under 18) will be required to sign a consent, permitting the Foundation and/or an agency it engages for this purpose to check the Finalist’s DMV driving record in order to be eligible to choose PRIZE 1 if selected the winner of the Contest.

GRAND PRIZE WINNER SELECTION AND NOTIFICATION.
The Grand Prize Winner (“Winner”) will be selected from the 10 Finalists who timely submit a Full Project Outline. The Winner will be selected by a panel of Judges who are in the field of teen safe driving and whose names will be revealed on the www.D3NJ.org website at a later date. Judging will be based on originality, creativity, adherence to the theme, and overall quality of the Full Project Outline.

The Winner will be announced at a ceremony on May 5, 2012 at a location to be announced, upon determining that he/she has met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers. Each Finalist must attend the ceremony on May 5, 2012, unless he/she cannot attend due to illness (which illness must be verified with a doctor’s note).

PRIZES
The Winner will receive his or her choice of either Prize 1 or Prize 2 described below. A Runner-up Prize is also available. In the event that a prize is won by a contestant who is under 18 years of age, for all purposes under these Rules, the parent or legal guardian will be recognized as the actual winner of the prize.

PRIZE 1
A 2012 Honda Civic EX. If winner selects Prize 1, he or she must have a valid driver license or learner permit on or before May 5, 2012, and will affirm in writing that he or she has not been charged with a moving violation, or involved in an at fault motor vehicle accident. This requirement does not apply if winner selects Prize 2. Winner is responsible to pay for all taxes, title and license fees.

PRIZE 2
A scholarship not to exceed the amount of $18,000. The actual scholarship disbursements may vary depending upon the cost of tuition, fees, room and board, and the amount of other financial aid received by the Winner from other sources. The scholarship will be paid upon proof of registration in a degree seeking program at a state or federal accredited university or vocational college (“Educational Institution”). All scholarship funds must be used for educational purposes only, such as tuition, fees, books, and room and board. All scholarship funds must be used within 5 years from the date of the Winner’s high school graduation. Any scholarship funds not used within 5 years of the Winner’s high school graduation shall be forfeited. The scholarship shall be paid directly to the Educational Institution upon receipt of a tuition bill from the Winner, or directly to the Winner upon receipt of proof that the Winner has paid his or her tuition bill to the Educational Institution.

RUNNER-UP PRIZE
The runner-up Finalist will receive a consolation prize of a cash scholarship in the amount of $500.

If the Winner is a minor, Prizes will be awarded in the name of his or her parent or legal guardian who must execute the necessary release and, if applicable, must accompany the Winner to the ceremony.

PRIVACY
Any and all names, contact information, and related information should be submitted only on the Registration Form and other required forms. Names, contact information, or any other personally identifiable information should not be included within any submission, as the submissions may be displayed on publicly accessible websites. If personally identifiable information is presented within any submission, the Sponsor may, in the Sponsor’s sole discretion, void or deem the submission ineligible.

ORIGINAL WORK OF PARTICIPANT.
Qualified Participants must not have granted any other person or entity prior right to use their submissions. Submissions will not be accepted or eligible if they include – in the sole judgment of the Sponsor— any content that contains or appears to contain:
  • Profane, obscene, or inappropriate material;
  • Endorses, encourages, glorifies, or condones drug use, underage drinking, alcohol abuse or any other illegal activity;
  • Nudity, profanity or gratuitous violence;
  • Inappropriate language;
  • Any express or implied commercial endorsement;
  • Any derogatory characterization of any person or group based on age, race, color, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, or other unethical or unlawful factors;
  • Any actual or apparent copying or other infringement of another's intellectual property rights.

CLEARANCES
Each Qualified Participant is solely responsible for obtaining from all applicable individuals or entities any and all required rights, releases, consents, clearances, licenses, and other authorizations necessary to exploit and otherwise use their submissions in any and all media. Clearances that may be required include, but are not limited to:
  • Location releases;
  • Releases from any person whose name, voice, likeness or persona is referenced, shown, or otherwise used in the submission(s);
  • If any individual depicted is under the age of majority, participants must obtain the signature of the individual’s parent or guardian on the applicable clearance(s).

By submitting Campaign Ideas, Qualified Participants warrant that the contents of their submissions do not infringe on any copyright owned by another, and/or that the content of the submission is within the bounds of the fair use doctrine. Qualified Participants also confirm that any statements made in their submissions are true and do not violate or infringe on the rights of third parties. All necessary clearances must be obtained and provided to Sponsor upon submission of the Campaign Idea and Full Project Outline. The Sponsor may disqualify any submission at any time if the Qualified Participant has not obtained all necessary clearances.

CONDITIONS OF PARTICIPATION
By entering, Qualified Participants agree to defend and indemnify Sponsor(s), Sponsor's affiliated entities (including without limitation the DCH Auto group and its affiliates), and their respective principals, subsidiaries, affiliates, shareholders, members, managers, directors, officers, employees, agents, representatives, vendors, media partners, individuals involved in this Contest (including, without limitation, the judges) and/or the like (hereinafter the “Sponsor Parties”) from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Contest as a result of receiving Qualifying Participants’ submissions and/or use and/or misuse of any Prize. The Qualifying Participant each release the Sponsor and each Sponsor Party from any and all claims by third parties or by the Qualifying Participant in connection with his/her submission(s). Each Qualifying Participant agrees that the Sponsor may retain a copy of his/her submission(s) and each releases the Sponsor from liability for any loss or damage thereto. Each Qualifying Participant also consents, approves and authorizes the Sponsor and/or any Sponsor Parties and/or gives them the right to use, broadcast, webcast, podcast, link to or from, syndicate, or otherwise exhibit or display the submitted video (or other materials) in its original and/or in an altered form or format. Each Qualifying Participant grants the Sponsor and the Sponsor Parties the unqualified, unrestricted, worldwide, irrevocable, perpetual and royalty-free right to use his or her name, logo, marks, submission entries, and other distinctive identification in connection with promoting or marketing the Contest or its theme, and future contests, materials or as the Sponsor determines.The rights described in these Rules begin immediately upon submission of the Campaign Idea.

TAXES.
All federal, state and/or local income and other taxes, if any, are the Winner’s sole responsibility.

LIKELIHOOD OF BEING SELECTED WINNER.
The likelihood of being selected as the Winner of this Contest depends on the number of eligible entries received, adherence to these Rules, and the quality of the entries as determined by the Judges in accordance with these Rules.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION. THIS PROMOTION IS VOID WHERE PROHIBITED.

A purchase will not improve chances of winning.

CONSUMER DISCLOSURE: You have not yet won.

NO PRIZE TRANSFER OR SUBSTITUTION.

No non-cash Prize or any portion thereof is transferable or redeemable for cash. Any portion of the Prize that is not used is forfeited. No substitutions for any Prizes except by Sponsor, in which case a Prize of equal or greater value will be substituted.

DISCLAIMERS.
(i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor’s servers or elsewhere, will not be eligible. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
(ii) (Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the web site. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Sponsor.
(iii) Sponsor further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort.
(iv) SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE.
(v) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.


APPLICABLE LAWS AND JURISDICTION.
This Contest is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Rules shall be governed by the laws of the State of New Jersey. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in New Jersey. Should there be a conflict between the laws of the State of New Jersey and any other laws, the conflict will be resolved in favor of the laws of the State of New Jersey. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.
